ADU Regulations Homeowners Should know

ADU REGULATIONS 2026 UPDATED

ADUs Are Now Allowed “By-Right” Statewide

  • As of January 1, 2026, ADUs are effectively legal across Arizona on most residential lots

  • If cities/counties didn’t adopt rules, state law automatically allows ADUs anyway

→ You generally no longer need special approvals, rezoning, or variances.

TUCSON ADU REQUIREMENTS

What you're allowed to build

  • At least 1 attached + 1 detached ADU per lot

  • Potential for additional ADUs on larger lots (1+ acre)

  • Size limits:

    • Up to 75% of the main home

    • Typically capped around 1,000 sq ft

→  More flexibility than ever, but still within reasonable size limits.

Local Government has limited restrictions

Cities and counties cannot:

  • Require additional parking

  • Require matching exterior design

  • Require family-only occupancy

  • Impose stricter setbacks than primary homes

  • Force restrictive covenants for approval

→  The state has removed many of the barriers that previously slowed projects down.

Rental Rules Updated 2026

Rental Rules for Casitas & ADU's

  • Long-term rentals are fully allowed

  • Owner occupancy is NOT required for long-term renting

⚠️ However:

  • Short-term rentals (Airbnb-style) are more restricted and evolving

  • Some proposals aim to limit or prohibit ADU short-term rentals

  • HOAs can still impose their own rules

→  Rental income is viable — but short-term use is less certain.

TUCSON ADU REQUIREMENTS

Counties Are Now Required to Allow ADUs Too

  • HB 2928 expanded rules beyond cities → applies to counties as well

  • Counties must allow ADUs on residential lots

→  Even rural or unincorporated areas are now included.

Important limitations still apply

Even with easier laws, you still must follow:

  • Building & safety codes

  • Fire and access regulations

  • Utility and septic requirements

  • No building over utility easements without approval

🚫 ADUs may be restricted in:

  • Airport zones

  • Military zones

  • Tribal land
